SWISS CODE OF CIVIL LAW...Section 252-327.....This is "word for word" the swiss code of law........After a divorce the parent with custody has the right to decide where the child lives, and in the case of a foreign parent with custody can return to his/her country with their children.
Personally I think this law is insane but in this case...I will take it....BUT....The flip side ,with this law on the books will it mean the custody battle of custody battles.. Think it out....If Shania wins...She wins big..She has Eja and can live where SHE wants... On the other hand I can't help but feel that it raises the chances that Mutt will be more inclined to go for custody since Eja(as he knows) would likely end up in Canada giving him terrible access to him. Good to know. This is the son Shania bared and did a fine job of motherly raising. She has a good fighting chance. Both are foreigners so Mutt has the same position as Shania that they are not native Swiss.
Yes, this is good news for Shania regarding the chance she might bring him to Canada.I hope, I really hope that this divorce goes well and that they are both able to come together to discuss what is in the best interest of Eja. Shania should be given full custody, there should be no question about that. Where they live? Well that will be a huge decision.
I think she will win if it comes down to a custody battle...First she is a woman and that usually seems to make a difference still in todays world, she is younger, she has strong family roots, she buys into the hermit life much less than mutt,and of course(their ace in the hole,if they can prove it)...the affair allegations....As far as the "carreer" card being brought into the mix...they both have careers...I think she is in a pretty strong position...Bob

I respect your position and admire your hopes on this one...Having said that I would trust that you would want her to walk on him IF the affair thing is proven...On the flip side if there is nothing to it then there could still be some hope but I would suggest VERY little...Shania doesn't jump on a jet and fly back to Canada as well as allow her spokeperson to announce the separation unless she meant serious businness.

True and I also admire kay's wishful thinking. It would be nice if there was still hope that this all wasn't as bad as it seems. Like waking up from a bad dream. I so wish.

Maybe I am being a little optimistic, but I have faith that things will work out for Shania and Mutt. After all she's said about their relationship and all those songs they wrote about each other, it doesn't seem that a love like theirs should die like this.
If an affair did occur, it is their business who did what to whom. People can forgive.
If Mutt did do something to upset her, she has sent him the message that she won't take it and will leave him. Sometimes people need a "wake-up" call. That may force him to mend his ways.
I don't think either of them want to be away from Eja on a day-to-day basis. It seems like if things were extremely bad, Mutt would have put up a fight so she wouldn't take Eja to Canada or she wouldn't have left Switzerland to go to Canada (if Eja is with Mutt).
Did she actually file for a "legal separation" or has there just been an announcement about a "split"?
What's the standard time (in Canada) to go from split to legal separation and then legal separation to divorce?
Kay, I admire your positive thoughts on this but although it breaks my heart to say this I really believe Shania would not of walked out (gone to Canada) if things were not seriously bad. For me, having seen friends go thru a divorce, it appears like mutt and marie - ann have already talked to lawyers and their statements to the press reflect that. As for whether or not this is a legal separation....it definitly appears so. There is nothing positive about divorce. Bob, you have uncovered information that seems positive for Shania. I hope she is able to find a good lawyer. I also hope first that this is all false but if it is true then I hope she gains custody of Eja. My thoughts and prayers go out to all of them.
Legal separation...Pretty quick if you are dealing with 2 mature adults..About 2 months....About 2 years for the final divorce.... I am currently researching my tail off trying to establish jurisdiction on the matter as far as what Country will have the final say on Eja....As far as the money part, I have no doubt it will be settled behind closed doors by war class lawyers. Eja is the wild card....If they both want custody...Those closed doors swing open and it becomes nail biting time..As far as I can establish Switzerland will have jurisdiction on the Eja issue since he was born there but that is really iffy...Still working on that end of things. If (note if) shania has the right to fight out the Eja thing in Canada.....Well Mutt would be nuts....I think being from Canada I could say...His chances of victory would be slim... Besides...Judges are only human...They have likely danced to their little Canadian girl themselves...You figure it out?????.
Thank you Bob for researching this information. I wonder if you could email it to Shania's camp. It might be nice for her to know her fans are looking out for her. Well the Swiss gala has come and gone. Shania of course did not attend. Maybe another indication that she is really hurting.
Her name's Johanna and she's 7, this must be Eja's little girlfriend - the one Shania talked about on etalk with Ben Mulroney, when promoting Starlight.

i think maries husband traveled for work,shania traveled Mutt stayed home she was in the home,could have started at anytime,thats really got to suck thinking she's your friend and not knowing how long she's been screwing him
I'm not defending Mutt, but I do believe he loved Shania and wouldn't have conceived a child with her if he was involved with someone else at the time or if he wasn't warming to the idea of becoming a father.
It appears his relationship with the housekeeper occurred recently, because things seemed fine between Shania and Mutt up until then. Maybe as they were growing apart, and things started going wrong in Marie-Anne's own marriage, they felt drawn to each other. As the couples started spending more time together e.g. going on vacations, this gave them chance to bond and for him to get to know Marie-Anne on a friendship-level. It doesn't mean to say he has always had feelings for her or he acted upon those feelings straight away, those feelings may not have developed until years later. Who knows? It's just a shame Shania had no idea that he was playing the field and with whom.
I'm sure Mutt didn't intend for things to end this way, or his choice of words 'unfortunate', but he still wants to be friends and not put Eja between them.

Marie had a broken marriage right from the start. She could had a romantic enconter or one night stand with Mutt. When Shania was out town. So maybe there could be a possibility that Johanna his Mutt daughter and not Marie husband.
No matter how you look at it, it all comes down to Mutt's inability to stay committed to one woman. This is a sad reputation. If Shania stays in Switzerland to give Eja stability in school and to be near his father than she has to deal with Marie and Mutt being together. My only advice for Mutt is he should have Marie sign a prenup. As for Shania, I think she will go through this just fine. She is a strong woman.
We don't know for a fact that Marie-Anne's marriage was doomed from the start, she was with her husband for 8 years, their problems may not have developed until much later. We also don't know when the affair began.
So the so called spiritual man who supposedly with his wife doesn't necessary believe "sleeping" is what life is all about and that there are other important priorities and finer things in life, turns around and shocks the world by "sleeping" with his and his wife's friend? The whole think still doesn't make sense. What a slap in the face. Just when I thought there were still decent things in this world...
I bet a photo of Mutt and Marie will surface eventually taken by a paparazzi. Yes, I agree. Shania and Mutt do have good friends around them as other than the People magazine article there has been nothing new. I completely discount the other rags.
Yes Lulu, I agree. i bet we'll see a pic soon,European paparazzi don't have much repsect,even here in Greece,they jump on balconies,climp un on rooftops. i think Mutt won't be able to hide for long. and yes,magazines like Star,National Enquirer etc. are filled with outrageous lies,but i don't remember People ever being like that.
